2. Contractual commitment and duration

8. Delivery date

9. Consequences of delay in delivery and performance
In the event of a delay in delivery, Tim Michalek NocturaSys will inform the customer immediately and propose a new delivery date. The customer has the right to withdraw from the contract after setting a reasonable grace period if delivery is not made within this grace period.
10. Liability for defects
If the delivered goods are defective, the customer has the legal right to subsequent performance (repair or replacement delivery). If subsequent performance fails, the customer can withdraw from the contract or reduce the purchase price.
11. Retention of title
The goods remain the property of Tim Michalek NocturaSys until the purchase price has been paid in full.
12. Limitation of Liability and Exclusion of Liability
Limitation of Liability:
Tim Michalek NocturaSys is only liable for minor negligence if essential contractual obligations (cardinal obligations) are violated.
